In the name of God Amen The ffouerteenth day of May in the yeare of our Lord God one thousand sixe hundred thirty fouer and in the yeare of raigne of our Soveraigne Lord Charles by the grace of God Kinge of England Scotland ffraunce and Ireland defender of the faith I John Hales of Boughton Maleherbe in the County of Kent Gent being of a whole and perfect memory thankes be to God doe make and ordayne and declare this my present testament and last will in manner and forme following that is to saye first I bequeath my soule into the hands of Allmighty God my mercifull father hopeing by the meritts and blessed passion of Jesus Christ my Saviour that fragile and transitory life being ended to emergethat place of rest and eternall happines in heaven which he hath purchased for me and for all time be ? And I bequeath my body to be buried in Christian buriall And as concerning my goods and Chattels I will and bequeath unto Margaret Hales my wife the Lease of the parte of the Mannor of ? with the Lease of the ? of the sayd Mannor but if it happen that she departe this life before the end of the sayd Leases Then I will that my sonne William Hales shall have the sayd Leases Alsoe I will that shee shall have during her life the profitt of two hundred pounds of lawfull English moneye the which two hundred pounds I will and bequeath unto my fouer yongest sonnes Edward Hales John Hales Richard Hales and Henry Hales to each of them fifty pounds a peese to be paid unto them by my Executor at their severall ages of one and twenty yeares and the profitt of the sayd two hundred pounds to be paid unto them by him equally till they shall attayne unto the sayd age of one and twenty yeares And if shall happen that any of them shall dye before they come to the sayd age That then his parte to be devided amongst the other of the sayd fouer sonnes that shall survive to be paid to them with the profitt as aforesayd by my Executor Alsoe I will unto my sayd wife and to my three daughters all my stock and household stuff my funerall & debts discharged shee to have the use of all untill they marrie or come to the age of one and twenty yeares and then to be devided into fouer parts amongst them And I will and bequeath unto my Eldest sonne Anthony Hales one hundred pounds of lawfull English money to be paid unto him at the age of one and twenty yeares by my sayd Executor and the profitt thereof untill he come to the sayd age And if it happen that he shall departe this life before he shall attayne unto the sayd age of one and twenty yeares Then I will the sayd hundred pounds to be equally devided amongst the three eldest sonnes which shall then be liveing of mee the Testator And I will and bequeath unto Humfrey Hales my second sonne and to William Hales my third sonne one hundred pounds of lawfull English money ffifty pounds a peese to be paid unto them at their severall ages of one & twenty yeares And if it shall happen that any of them shall departe this life before they come to the age of one and twenty yeares that then his portion shall be paid to him or them two that shall survive and if they ? happen to departe this life before they come to the age of one and twenty yeares That then the sayd hundred pounds to be paid by my Executor equally amongst all my sonnes which shall then be liveing and come to the age of one and twenty yeares with the profitt thereof unto all of them before named until they shall come to the sayd age of one and twenty yeares Alsoe I bequeath fifty pounds of lawfull English money unto the childe which my wife is now great with all to be paid unto him if he be a sonne by my Executor at the age of one and twenty yeares And if it be a daughter at the sayd age or at the day of marriage with the profitt thereof untill he or shee shall come to the age of one and twenty yeares Alsoe I will that ffifty pounds of like English money to be imployed by my sayd Executor in? putting forth my younger sonnes Apprentises the profitts thereof to be paid unto them in the mean tyme Alsoe I will and bequeath unto Sr John Hales of Tunstall in the sayd County Knight my booke of the printe of the Bible and twenty shillings to buy him a ringe whome I make of this my last will and Testament sole Executor In witness whereof to this my last will I have sett my hand and seale the day and yeare first above written John Hales witnesses present at the sealing of this my last will & testament Thomas Greenwood John ?
The Fifth day of May in the yeare of our Lord one thousand sixe hundred fifty one there went forth a Commission to Edward Hales the naturall and lawfull sonne of the sayd deceased to Administer all & singular the goods chattells and debts of the sayd deceased according to the tenor and effect of this the last will and Testament (because that the Executor herein named died before he tooke upon him the execution of this will) he the sayd Edward being first sworne well & faithfully to Administer the same.
[Note by compiler: This will was executed on May 14, 1634, but was not proven until May 5, 1651. It appears from this will that the testator's wife was named Margaret, and that she was pregnant at the time the will was executed. It also appears that at the time the will was executed, the testator had seven sons (Anthony, Humpfrey, William, Edward, John, Richard and Henry) and three daughters (whose names are not listed in the will). The testator's son, Edward, served as administrator of the testator's estate because the executor named in the will died before the will was proven.]
