(9) The following transcriptions of Joseph HODGES' Will, and of other documents filed in the Orphans Court of Jefferson County, AL in connection with the probate of Joseph's estate, have been made by the compiler from copies of those documents provided to the compiler by Dianne Ferrill :
I Joseph Hodges of the State of Alabama Jefferson County, do make and ordain this my last will & Testament in manner and form following to wit,
I give and bequeath to my grand son John Wesley Austin one bay horse also one white heifer.
I give and bequeath to my grand son Jesse Austin one spotted heifer.
I give and bequeath to my son in law Leroy Austin the use of what land he has cleared and what he may clear, so long as he is disposed to live on it and cultivate it himself.
All the rest and residue of my estate goods and chattels, I give and bequeath to my dear beloved wife Neomi Hodges, also my son James and daughter Mary during their lives, and at their deaths all equally devided between the rest of my children with the exception of my land, that to be equally between my two sons John C. Hodges and Jesse E. Hodges. I nominate constitute and appoint my beloved wife sole executrix of this my last will and Testament, hereby revoking all other wills by me at any time heretofore made. In witness whereof I have hereunto set my hand and seal this 8th day of August in the year of our Lord 1840.

Know all men by these presents, That we John C. Hodges, William Snow and William H. Snow are held and firmly bound unto John F. Forrest Judge of the County of Jefferson County, State of Alabama, and his successors in office in the penal sum of Two Thousand and five hundred dollars, to which payment, well and truly to be made, we and each of us do bind ourselves, our heirs we firmly by these presents, sealed with our seals and dated the 24th day of May 1846.
Now the condition of the above obligation is such that whereas the above bound John C. Hodges has been duly appointed Administrator with the will annexed of Joseph Hodges decd. Now if said John C. Hodges shall well and truly perform all the duties which are or may be required of him as administrator then the above obligation to be void - else to remain in full force and intent. Witness our hands and seals the date above written.

The State of Alabama
Orphans Court of Jefferson County
Whereas the last will and Testament of Joseph Hodges was duly proved at an Orphans Court held for said County at the Court House in the town of Elyton on the 24th day of May 1844, in which will he appointed Neomi Hodges his Executrix, who relinquished her right to execute said Will. Whereupon John C. Hodges was appointed administrator [with the] will annexed, and said John C. Hodges having given bond and securities, and taken the oath required by law. Therefore that the will of said Testator may be well and truly performed, we by these presents, grant and commit to said John C. Hodges the administration of all and singular the goods and chattels, rights and credits whatsoever belonging to said Joseph Hodges at the time of his death, according to the true intent and meaning of said Will, hereby requiring said John C. Hodges to file in the clerk's office of said Court, within three months from this a true and full inventory of said Goods and Chattels, Rights and Credits, and to render a full and true account of his administration, whenever thereto legally required.
Witness John F. Forrest Judge of said Court, at Office this 24th day of May 1844.
