      THOMAS OVERSTREET, SR., lived in Bedford county, Va. He is listed in "Virginia Taxpayers of 1782-1787" Bedford county, along with Thomas Overstreet, Jr., John Overstreet, William Overstreet, and Thomas Overstreet. His wife was Agness _____. He died in 1792. A copy of his will follows, in which he names his wife and children.

      KNOW ALL MEN by these Presents that I Thomas Overstreet Senr. of the County of Bedford & state of Virginia do make & Ordain this my Last Will & Testament touching such Wordly Estate as it hath pleased God to bless me with that is to say (viz) 1st Item the first I order & Ordain that all my Just Debts & Funeral Charges be paid by my Executors hereafter named 2d Item the second I give & bequeath unto my Loving Wife Agness Overstreet all my Estate Real & Personal (Viz) Lands Negroes Chattles good &c after paying my Just Debts during the time of her Widowhood & if she should Marry then she shall Relinquish two thirds thereof to my Children to be Disposed of as shall be hereafter Directed & the Other third part shall be hers during the term of her Natural life & then to Return to my Children as the other or if she shall not marry to have the whole to the time of her Death. 3d. Item the third whereas I have given to my Son Thomas Overstreet a tract of Land which he hath disposed of & now sold him another My Will is that he shall pay up the whole of the Price to my Estate to be Divided with the Rest & that my Executors shall make him a Deed to the Land when he shall make Payment According to Agreement 4th Item the forth I give & Bequeath to my Son John Overstreet that tract of Land whereon he now lives Containing two hundred Acres more or Less Joining to Lands of Auston, Fauster & Wigginton Exclusive of his Equal part hereafter mentioned. 5th Item the fifth I give & Bequeath to my six Children (Viz) Thomas Overstreet Ann Hail William Overstreet Mary Witt Elizabeth Keath & John Overstreet all the Remainder of my Estate Real & Personal to be Equally Divided between them as followeth two thirds thereof at the marriage of my Widow if she should Marry & the other third at her Death or all at her death if she should not Marry at all. 6th Item the sixth I do hereby nominate Constitute & appoint & by these Presents have nominated Constituted & appointed my sons John Overstreet & Thomas Overstreet Jun. Executors of this my Last Will & Testament & I do further Disanul Disallow & Renounce all former Wills Legacies or Testaments by me made done or Bequeathed Rattifying & Confirming This & this only to be my Last Will & Testament In Witness whereof I have hereunto set my hand & seal this Seventeenth day of December In the year of our Lord one thousand seven hundred & ninety one (1791) the Occation my son William not being mentioned till in the fifth Item was on account of his having had Land Given him before -

      At a Court held for Bedford County the 27th day of February 1792.

      This Last Will & Testament of Thomas Overstreet Deceased was proved by the oaths of John Overstreet & by the solem affirmation of Joel Lewis Witnesses whose names are thereunto subscribed & Ordered to be Recorded & on the motion of Thomas Overstreet the Executor therein named who made oath thereto Certificate is Granted him for Obtaining probate thereof in due form on giving Security whereupon he together with William Trigg & John Trigg his Securities entered into & acknowledged their Bond in the penalty of Two Thousand Pounds Conditioned for the said Executors due & faithful administration of the said Estate & performance of his Will.
