"Dolor Davis, & his sons," were in the Barnstable section of the 1643 Plymouth Colony list of men able to bear arms [PCR 8:193].

ESTATE: On 4 August 1634, "Dollard Davis" was granted twenty-five acres in Cambridge [CaTR 8]. In the Cambridge land inventory on 4 June 1635, "Dollard Davis" held two parcels: "one house lot of half a rood"; and "upon the west side of Charles River twenty & five acres" [CaBOP 10].

On 25 August 1635, "Dollerd Davis" sold to Richard Girling "all the right he hath in five and twenty acres of land . . . on the west side of Charl[e]s River" [CaBOP 15]. On an unknown date, Dolor Davis disposed of his town lot to Simon Willard, and by 1639 Willard had sold it to Edward Mitchelson [CaBOP 66].

On 6 April 1640, Dolor Davis and seven other men were granted "the lands lying on the norwest side of the Northill in Duxborrow," the meadow there to be divided amongst them by a committee [PCR 1:144]; on 31 August 1640, when some of the land was actually laid out, there were eight other men, and Dolor Davis received fifty acres [PCR 1:161].

On 20 August 1655, Roger Draper of Concord, husbandman, sold to "Dolar Davis of the same town . . . , husbandman, . . . all & all manner of those housings, lands, meadow and other appurtenances whatsoever belong thereunto lying & being within the limits of the town of Concord, the particulars whereof are as followeth, that is to say one parcel or lot of upland about his house containing by estimation twenty and three acres . . . with ten acres over against his house on the other side of the north river and twenty acres more, eleven of which is meadow called by the name of Mr. Martin's meadow, eight acres of it upland joining to the meadow on the northeast side next the common with three acres of swamp meadow in it . . . , also three acres of meadow more or less called by the name of stickfast meadow . . . , more eight acres of upland lying in a nook or corner . . . , more eight acres of meadow be it more or less lying in the meadow called the fifty-acre of meadow . . . , also eight acres of upland" [MLR 3:188-90].

On 17 July 1658, "Dolor Davis late of Barnstable . . . , house carpenter," sold to Abraham Blush of Barnstable, planter, "all that my houselot of lands with sundry other parcels of land" in Barnstable, as follows: "the said house lot lying by a place commonly called the old mill creek containing ten acres of upland . . . , with four acres of upland be it more or less adjoining thereto . . . and ten acres of marsh . . . , also fourteen acres of upland . . . with eight acres more of upland adjoining . . . , and also certain parcels of upland lying and being at a place commonly called Kempton's Field, and also certain parcels of land lying and being at a place commonly called Stony Cove Field, viz: four acres of upland . . . , also a parcel of upland containing seven acres . . . and one acre of upland"; acknowledged at Concord 17 July 1658 by "Dolar Davis and Margery his wife"; acknowledged again at Barnstable 16 February 1667[/8?] by Dolor Davis alone [PCLR 3:119]. (On 9 April 1656 and 9 May 1656, "Dolar Davis of Concord" signed receipts to Abraham Blush of Barnstable for cows, presumably as advance payment for these lands [PCR 7:211].)

In his will, dated 13 September 1672 and proved 2 July 1673, "Dolar Davis" of Barnstable, "being weak and crazy in body," noting that "I having already given my son[s] Symon and Samuel their full portions and deeds for their lands," bequeathed to "my dear and loving wife Joanna" £5 to be paid at Mr. Brattle's in Boston and £4 to be paid in English commodities during the term of four years; to "my eldest son John my house and barn and outyard with several parcels of land lying in Concord . . . , viz: all my land about the said house . . . containing by estimation twenty acres more or less, as also a piece of upland and meadow containing six acres . . . , as also thirteen acres of upland more or less, adjoining to my seven acres of meadow on one side, which said seven acres of meadow are also hereby bequeathed to him . . . , as also thirty-two acres of upland and swampyish meadow . . . , as also five acres of upland," with additional conditions regarding the bequest to the testator's wife; "my son Symon shall have another crop after this year's from that piece of my land that lies near his house for which he is to pay" 20s.; to "my son John a bill of four pounds due to me from Roger Chandler of Concord to satisfy for the charges of my coming from Barnstable to Concord and to provide his son Joseph who came to attend me," also "all my carpenter's tools and my serge suit and cloak"; to "my son-in-law Lewis my cloth suit and coat and hat and to my daughter Mary his wife a cow," also 50s. being half a note due from "my son Samuel," and the residue of household stuff "now in my dwelling house at Barnstable"; to "my daughter Ruth Hall besides what she hath received from me, a cow which her husband hath at present in his keeping," as also 50s., the other half of the note due from "my son Samuel," they to pay 5s. "for me to William Butterick"; to the poor of the town where "it shall please God that I die, whether at Concord or at Barnstable," 10s.; "my said son John the sole executor"; "loving and respected friends William Butterick, Richard Hassell and Thomas Browne," overseers. A codicil of the same date gave "unto my son John Davis twenty acres of woodland which is by the twenty-seven acres which belongeth unto twenty men . . . in the town of Concord"; "I do give my red mare unto my wife Joanne" [PCPR 3:1:72; MD 24:71-73].

On 4 July 1673, Plymouth court ordered "Mr. Hinckley to take an oath of Joannah Davis, widow, at Barnstable, for the truth of the inventory of the estate of Dolar Davis, deceased, which inventory bears date the 19th of June, 1673" [PCR 5:123]. At the same court, "John Davis is allowed and approved by the Court to be executor to the estate of Dolar Davis, deceased" [PCR 5:125].

On 5 July 1673, "John Davis, son and sole executor of the last will & testament of Dollar Davis, late of Barnstable in Plitnouth Colony deceased, is empowered to administer on any part of his father's estate that shall be found in this colony, he discharging all debts & duties due & owing from the said estate & bringing in a true inventory as the law directs" [MCR 3:56]. The "inventory of the estate of Dollar Davis deceased, within the bounds of Concord in the County of Middlesex," taken 8 July 1673, totalled £119 19s. 7d., of which £113 was real estate: "the housing & houselot, 20 acres," £60; "six acres of upland & meadow more adjacent," £7; "seven acres of meadow in the eleven-acre meadow with 13 acres of upland adjacent," £26; "five acres of upland near John Heald's, broken up and fenced in," £12; "twenty acres of land in that tract of land called the twenty," £3; and "thirty-two acres of second division land," £5 [MPR 3:291].

BIRTH: By about 1599 based on date of marriage.

DEATH: Between 13 September 1672 (date of will) and 19 June 1673 (date of inventory). (Some secondary sources claim that the death took place at Barnstable on 22 June 1673, but this death is not found recorded at Barnstable or Concord, and this claimed date is three days after the Barnstable inventory.)

MARRIAGE: (1) East Fairleigh, Kent, 29 March 1624 Margery Willard. She was baptized Horsmonden, Kent, 7 November 1602, daughter of Richard Willard. She was living on 17 July 1658, when she acknowledged a deed, but was probably dead by 16 February 1667[/8?], when she did not participate in a second acknowledgement of the same deed [PCLR 3:119].

      (2) On an unknown date Joanna (Hull) Bursley, daughter of Rev. JOSEPH HULL {1635, Weymouth} and widow of JOHN BURSLEY {1623, Weymouth} [GMB 1:2811.

      CHILDREN:

      With first wife

i JOHN (eldest son), b. about 1626 (aged 9 in 1635 [Hotten 68]); m. "Nocett [Eastham]" 15 March 1648/9 Hannah Linnett [NEHGR 9:286; PCR 8:43; MD 4:2231, daughter of ROBERT LINNETT {1638, Scituate} (in his will of 23 January 1662/3, "Robert Linell" included a bequest to John Davis [MD 15:58, citing PCPR 2:2:4]).

      ii MARY, b. about 1631 (aged 4 years in 1635 [Hotten 681); m. Barnstable 15 June 1653 Thomas Lewis [NEHGR 9:287; PCR 8:451, son of GEORGE LEWIS {1635, Scituate} [TAG 68:25-26].

iii ELIZABETH, b. about 1634 (aged 1 year in 1635 [Hotten 681); no further record.

      iv SIMON, b. about 1637 (d. Concord 14 June 1713 "in his 77th year" [CoVR 82]); m. Concord 12 December 1660 Mary Blood [CoVR 9].

      v SAMUEL, b. say 1640, m. (1) Lynn 11 January 1665/6 Mary Meddowes; m. (2) Lynn 18 October 1711 Ruth Taylor.

vi RUTH, bp. Barnstable 24 March 1643/4 [NEHGR 9:282]; m. Concord 3 December 1663 Stephen Hall [CoVR 12].

ASSOCIATIONS: Margery (Willard) Davis, wife of Dolor Davis, was sister to SIMON WILLARD {1634, Cambridge}, baptized Horsmonden, Kent, 7 April 1605, immigrant to Cambridge, Concord and Lancaster, and to GEORGE WILLARD {1638, Scituate}, baptized Horsmonden, Kent, 4 December 1611, immigrant to Scituate and Maryland. These connections clearly had a powerful influence on the residences chosen by Dolor Davis. Nicholas Davis of Barnstable and Newport was almost certainly related to Dolor Davis, and some have thought he was a son of Dolor, but the available evidence is not sufficient to make this conclusion [TAG 64:113-18, especially 116].

COMMENTS: In his will, dated 13 July 1614 and proved 1 November 1614, James Clarke of East Farleigh, Kent, gentleman, bequeathed to "Dolor Davis, my servant, my house and land lying in the parish of Marden, the which is in the occupation of one Terrye" [Waters 2:1109, citing PCC Lawe 118].

On 17 April 1635, "Margeret Davies," aged 32, "Jo: Davies," aged 9, "Marie Davies," aged 4, and "Elizabeth Davies," aged 1, were enrolled at London for passage to New England on the Elizabeth [Hotten 68].

On 3 May 1641, Thomas Chambers, Dolor Davis and John Twisden, all of Scituate, served as sureties for Dolor's brother-in-law George Willard of Scituate, who had been fined for speaking disrespectfully of the magistrates [PCR 2:14].

Dolor Davis was one of the first promoters of the town of Groton, but he probably never resided there, as the only Groton records we have for him were in 1655 and 1656, when he was residing at Concord. On 16 May 1656, Dolor Davis was one of eight men who signed a petition to the General Court, asking for some concessions in the terms of settling Groton [NEHGR 33:209-10, 36:167-70].

Dolor Davis moved to Concord at the charges of Roger Chandler, and eventually became one of the twenty Barnstable and Marshfield men who settled the 1658 grant of 400 acres in Concord owned by Chandler and others (for an interesting discussion of this small migration, see NEHGR 87:116-17).

BIBLIOGRAPHIC NOTE: In 1881 Horace Davis compiled the principal account of this immigrant [Dolor Davis: A Sketch of his Life with a Record of his Earlier Descendants (n.p. 1881)].
